1. Preamble

This policy outlines the way Ordonnia uses your Personal Information for the operation of its services. It is established solely in the English language.

In this policy, the following terminology is used:

We operate under the jurisdiction of the Czech Republic. As such, we process any Personal Information you provide in accordance with the General Data Protection Regulation of the European Union, and more precisely the Act No. 110/2019 Coll. of the Czech Republic.

Our basis for the processing and usage of your Personal Information is the contractual relationship you have started with Ordonnia when using the Service, as outlined by our Usage Policy and our other Core Policies.

We also collect additional information with your consent, namely information pertaining to marketing, analytics, or advertising.

Some Personal Information is processed on the basis of our contract with you (e.g., providing the Service), while other data, such as for marketing or analytics, is processed based on your explicit, withdrawable consent.

b. Automated decision processing

Automated decision making is only used for internal prioritization, moderation, approval, or routing purposes. It does not produce legal effects or similarly significant consequences for you. If it ever does, we will ask for your explicit consent and inform you of the logic involved.

Ordonnia will use your Personal Information for the good operation of its Service, and for other reasons, such as marketing, analytics, or advertising. Unless explicitly disclosed so, we never sell any data to a third-party.

We retain your information until your contractual relationship with the Service expires, and for an additional two years after that. Some information, such as invoices, or compliance information, may be kept for longer on the basis set by law.

The Service may disclose your information to our Mandatees, mainly for the proper operation of the Service. Our Mandatees are held to strict data protection frameworks and may not reuse your data or keep your data outside of the use they must make of it to help us operate the Service.

b. Hosting providers

Your information is securely stored by Be1Host SAS (commercially trading as "InovaPerf"), registered in France under the SIRET 801 425 224 00020, at the address 14 rue Charles-V, 75004 Paris, France.

Our Service is often routed through the Cloudflare proxy, operated by the company Cloudflare, Inc. registered in the United States of America, at the address 101 Townsend St, San Francisco, CA.

We may use other temporary hosting providers for your data that adhere to strict privacy regulations and that cannot directly access your data.

c. Third parties

Your Data or Personal Information may also be disclosed to other third parties. We use Google Analytics, Google AdSense, and Google Tag Manager for the operation and advertising of our Service. Your information may also be disclosed alone or grouped with other information after full anonymisation to disclose statistics for marketing, commercial or educational purposes.

We may transfer your data to servers based in the United States of America or in Canada. When these transfers happen, they are done under framework agreements that ensure a protection level equivalent to the one set forth by the General Data Protection Regulation.

5. Security of your information

We strive to keep your information always secure. Your data is always transmitted to us over the HTTPS protocol (or similarly secured protocols) and is stored on secured servers with up-to-date software and robust security precautions.

You are responsible for maintaining the confidentiality of the credentials you use to access the Service. Ordonnia or its Mandatees will never ask you for your password, or for any sensitive personal information outside of the Service.

6. Your Rights

a. Contractual rights

We undertake to give you the fullest control of your personal data as possible. We will undertake to modify any Personal Information at your request, and to let you access all of your personal information through our Service.

Should you want to have your account deleted, we offer a simple account anonymization process that will clear all Personal Information (but not Data) from your account. You may request this procedure (known as "Identity deletion") through our contact channels detailed on our Usage Policy.

b. Legal rights

We will honor the privacy rights applicable to your current region or country.

If we do not have substantial evidence of your residence in the country for which you request to apply the rights of, we may request additional evidence, such as a proof of Identity. We do not keep any proof of Identity beyond verification.

All request to exert a legal right, such as your Right to Erasure, must be sent to [email protected]. Our Mandatees are not fit to assist you through our usual support channels, and these support channels may only be used for general information.

You have the right to object to the processing of your personal data when the processing is based on our legitimate interests, or for direct marketing purposes, including profiling related to such marketing.

You have the right to request your Personal Information in a structured, commonly used, and machine-readable format, and to transmit that data to another controller where processing is based on consent or contract and carried out by automated means.
